What is a professional electric car?

As mentioned above, there are two types of electric vehicles professionals. These cars are available to employees free of charge as part of their work for the company. Company directors also use a business car for their activities, which are often SUV or electric saloons.

They represent a very attractive benefit in kind for company employees, saving them from having to use their own car in the first place, and thus saving on the costs associated with its use (recharge chargestolls, maintenance costs, etc.).

The main purpose of electric company and service vehicles is to allow employees to use their own means of transportThis includes travelling during working hours. However, although they are closely related and often confused, they are not identical in all respects.

What is the difference between the two types of car?

During his working days, the electric company car makes it easier for employees to get around. The big difference with the company car is that the company gives the employee complete freedom over its use. They have the privilege of being able to use their electric company car freely, outside their job and for purely personal purposes.

However, there are limits to its benefits, and employees are not free to do as they please. In principle, when an employer decides to give his employee an electric company car, only he has the right to drive it. This is the case in the vast majority of companies. However, it is quite possible, by mutual agreement with the company and on an exceptional basis, to make an exception and allow the employee to share his company car with a third party if he needs to.

Benefit from your company's insurance for yourself and even for your family. He can enjoy it at any time of the year, whether during the week, at weekends or even during school holidays. However, when they use their company's electric vehicle outside the course of their professional activity, they are not covered, all ancillary costs remain the responsibility of the customer. The employer therefore has no expenses to plan for.

The second difference with an electric service vehicle is not the least important. It is less well known. It is thean employee who has a company electric car can buy it back from the company at any time if they feel comfortable with it and want to use it in their daily lives. The main advantage of this approach for employees is that they can negotiate the purchase price of the asset with their company and obtain it at a preferential rate.

Can you use your company electric vehicle to go on holiday?

There is no precise answer to this question. There are no laws or regulations governing its use over long distances. Each company is free to establish its own rules on this point. We therefore strongly recommend that you check with your line managers beforehand, so that you can leave with complete peace of mind.

Can you carpool with your company electric vehicle?

The law is quite clear on this point. Deriving a financial benefit from a car that you do not own is strictly forbidden, whatever the nature of the activity. As the employee using the company's electric car is not the owner, it is logical that carpooling is formally prohibited.Be careful, it can be very costly, even leading to dismissal from the company!

Electric service car or company car?

Electric service cars are also known as "company cars", and are used by company employees to carry out their professional activities.

A company electric vehicle does not belong to a particular employee. This is one of the major differences between it and an electric company car. It belongs first and foremost to the company which leaves it freely at the disposal of its employees according to their needs and requirements.

Nonetheless, employees must only use this type of electric vehicle for business purposes in the course of their work (e.g. an employee using the company car to travel from the head office to the site and back). He is therefore obliged to return it at the end of his working day.

The electric service car under the law

The law is therefore clear. URSSAF (Union de recouvrement pour la sécurité sociale et les allocations familiales) can even, in certain situations, require a company to let them check their fleet of company cars to ensure that they are not being used as electric company cars. If this is the case, the company is liable to financial penalties.

However, in exceptional cases, the company can be flexible. It can allow its employees to use the company electric car outside work. This is often the case for the employee's journey from home to work. A trade union delegate may also borrow the company car in the course of his or her duties. This will have no impact on them and does not constitute a benefit in kind, as these are occasional situations.

In all cases, this situation is left to the discretion of the company, which can withdraw this right at any time, without asking the employee's opinion beforehand. Concerning the provision of electric company cars, they are not included in the employee's contract of employment. The employer therefore does not have to pay any compensation or social security contributions if this benefit is withdrawn. There are very strict and precise regulations in place to avoid any disputes with your employer.

Accidents and offences: what does the law say?

Whether it's a electric vehicle or service, in the event of an accident, the The procedure is much the same as for a conventional accident between private individuals. It begins with the drafting of a statement of facts and then follows its course.

Insuring your car fleet Professional electrical equipment is of course compulsory for companies equipping their employees. Even more so if they areelectric vans professionals transporting large quantities of goods or heavy equipment. Initially, in the event of an unintentional accident, the driver's liability will not be called into question. The same applies to any costs incurred in repairing the car, the insurance excess and, unfortunately, if there are any victims to compensate.

However, in the case of an intentional accident or in more serious situations, such as driving under the influence of alcohol or drugs, the company is in no way responsible for, and will not bear the costs of, any such accident. related to the claim in question. The employee will therefore be entirely responsible for these costs, and there is a good chance that he or she will be severely punished or even directly dismissed.

Unlike road accidents, employees are fully liable for offences committed while driving their company electric vehicle (Article L121-1 of the Highway Code). The exception is for fines such as speeding, illegal parking, failure to comply with the highway code, wearing a seatbelt, etc. The employer owns the vehicle registration document, which is in the company's name.

The employer is therefore directly liable for any fines received, but can avoid this by reporting the employee. However, under no circumstances can they demand a deduction from their salary to reimburse themselves. One last important point, since 18 November 2016 and in the interests of transparency, the employer is obliged to disclose the identity of any of its employees who have committed an offence while using the company vehicle made available to it or face a fine of between €750 and €3,750.

It is therefore more than advisable for employees to seek information to assert their rights and duties.

Electric business car: which one to choose for your business?

In conclusion

As we have just seen in this article, for a company, creating a car fleet of any size, or simply renewing it, is not a trivial decision. Each company has its own selection criteria. It needs to have electric vehicles that are adapted to its field of activity.

So it's vital that they meet the needs of their employees, while staying within their budget! So we can conclude that the trend is increasingly towards electrification, and companies are less and less reluctant to take the plunge!
