Data management policy for connected products

I - General information

 

1 - This data management policy applies to all connected products, and more specifically to smart electric charging stations, as well as to the associated supervision, maintenance and remote management services (hereinafter referred to as the « Connected Products »("BEEV"), marketed by BEEV, a simplified joint stock company with capital of €63,917.72, whose registered office is at 5 Rue Pleyel 93200 SAINT-DENIS and whose sole identification number is 851 682 807 R.C.S. BOBIGNY, in particular via its website https://www.beev.co/ (hereinafter the Website »).

 

2 - Its purpose is to inform users of the Connected Products (hereinafter referred to as the « Users ») on how BEEV collects, uses, shares and protects the data generated by the Connected Products, in accordance with Regulation (EU) 2023/2854 known as the DATA ACT.

 

3 - This management policy applies to data collected via the Website or as part of the contractual relationship and the use of Connected Products.

II - Definitions

 

Within the meaning of Regulation (EU) 2023/2854, known as the DATA ACT :

 

  • A Connected Product is an object that obtains, generates or collects data relating to its use or its environment, that is capable of communicating data relating to the product via an electronic communications service, a physical connection or an integrated access device and whose primary function is not to store, process or transmit data on behalf of any party other than the User.
  • An ancillary service is a digital service, other than an electronic communications service, including software, that is connected to the product at the time of purchase, rental or lease in such a way that its absence would prevent the connected product from performing one or more of its functions, or that is subsequently connected to the product by the manufacturer or a third party to add, update or adapt the functions of the connected product.

 

III - BEEV's obligations

 

Before concluding a purchase, rental or leasing contract relating to a Connected Product, BEEV will provide the User, in a clear and comprehensible manner, with at least the following information:

 

  • The type, format and estimated volume of product-related data that the Connected Product is capable of generating; ;
  • If the Connected Product is capable of generating data continuously and in real time ;
  • Whether the Connected Product is capable of storing data on an integrated device or on a remote server, including, where applicable, the period for which it is to be retained; ;
  • The way in which the user can access, extract or, where applicable, delete data, including the technical means required to do so, as well as their conditions of use and quality of service.

 

Before concluding a contract for the provision of a related service, BEEV will provide the User, in a clear and comprehensible manner, with at least the following information:

 

  • The nature, estimated volume and frequency of collection of product-related data that the potential data holder should obtain and, where applicable, the ways in which the User may access or retrieve such data, including the ways in which the potential data holder's data will be stored and for how long; ;
  • The nature and estimated volume of the data relating to the related services to be generated, as well as the methods by which the User may access or extract this data, including the data storage methods of the potential data holder and the retention period; ;
  • Whether the potential data holder intends to use easily accessible data itself and the purposes for which this data is used, and whether it intends to authorise one or more third parties to use the data for purposes agreed with the User; ;
  • The identity of the potential data controller, such as its company name and the geographical address at which it is established and, where applicable, of the other parties to the data processing operation; ;
  • Means of communication that enable the potential data holder to be contacted quickly and to communicate effectively with him; ;
  • The way in which the User may request that data be shared with a third party and, where applicable, stop the sharing of data; ;
  • The User's right to lodge a complaint ;
  • The duration of the contract between the User and the potential data holder, as well as the terms and conditions for terminating this contract.

 

IV - Data collected

 

The following categories of data are collected:

 

  • Device and operating status Data collected to check the status of the recharging point, firmware and security;
  • Charging and energy session data Information used to record charging events and monitor energy consumption;
  • User access and authorisation Data collected for the management of User identification and access authorisations;
  • Load profiles and configuration Data associated with setting, programming and managing load parameters ;
  • Related services data data relating to the use of services such as browsing history;
  • Metadata : timestamps, units of measurement, etc.

 

V - Data access

 

The User may request this via his customer account or by e-mail ([email protected]). 

 

The data will be provided: (i) free of charge, (ii) in a complete and structured, common and machine-readable format and (iii) as accurate and complete as reasonably possible.

 

BEEV may request verification in order to confirm the identity of the User or the authorisation of the person requesting access. 

 

VI - Sharing data with third parties

 

The User may authorise a third party to access his/her data, upon express request to BEEV, via his/her customer account or by e-mail ([email protected]). 

 

It is hereby specified that third parties must use the data exclusively for the purposes defined and must keep it confidential.

 

In addition, business secrets will be preserved and will only be disclosed to third parties to the extent that such disclosure is strictly necessary to achieve the purpose agreed between the User and the third party.

 

Third parties receiving data at the User's request must comply with their obligations under Article 6 of Regulation (EU) 2023/2854.
